Golf Course Accident
55-year- old Client severely injured his foot when he tried to maneuver his golf cart between the curb of a narrow golf course path and a golf course service vehicle parked to the side of said path. Liability was disputed and the case was tried to verdict. While Client was found to be substantially at fault for the accident, we were able to recover 6.5 times the amount of Defendant’s last settlement offer, which was extended 10 minutes before trial started.
Workplace Accident
While at work, Client suffered a shoulder injury by a third-party contractor. The injury required two arthroscopic surgeries. Defendant contested the nature and extent of the injury, as well as the need for surgery. The case settled at a contentious mediation which lasted all day, with Defendant paying $300,000 to Client, for pain and suffering and $75,000 to the Worker’s Compensation carrier, in settlement for their $140,000 WC lien.
Residential Accident
Client severely injured her ankle when she fell into an unmarked trench in the backyard of a home, while working as a part-time dog-sitter. Homeowner’s insurance carrier denied Client’s third-party personal injury claim, as it argued that the Workers’ Compensation exclusive remedy applied. After convincing defense counsel that Client’s case fit an antiquated, but still valid, exception to the WC exclusive remedy doctrine, the case settled for the $500,000 policy limit available to the homeowner.
